The general Terms and Conditions of Sale detailed below govern the contractual relationship between the 'User' (hereafter also referred to as 'You' or the 'Customer') and 'mathewsandpeters.com' (hereafter also referred to as 'We' or the 'Website'), belonging to the company Mathews & Peters. Both parties accept these Conditions unreservedly. These general Conditions of Sale are the only conditions that are applicable and replace all other conditions, except in the case of express. written, prior dispensation. We maintain that, by confirming your order, you have read and do unreservedly accept our general Conditions of Sale. These Terms and Conditions of Sale are important to you and Mathews & Peters as they are used to protect your rights as a valued customer and our rights as a business.

We reserve the right to update the Website and these Terms of Service from time to time, at our discretion and without any notice. It is solely your responsibility to keep up-to-date with the latest Terms and Conditions by checking back regularly. Your continued use of the Website following the publishing of updated Terms of Service will be taken to mean that you have read and agree to the changes.

Access to the Website

We work hard to ensure the Website is always up and available, but we can't guarantee that the Website will not have downtime for any reason. We reserve the right to close the Website for short periods of time for general maintenance, but will attempt to keep this to a minimum. We will not be liable if for any reason all or any part of the Website is unavailable at any time, for any length of time.

Parts of the Website require you to input a password to access certain features. This is to be able to give you details relevant to your order whilst still keeping them private to you. There is a password reset procedure in case you forget your password. Mathews & Peters takes great care when putting product information, descriptions and images on-line but will not be held responsible for any mistakes or omissions to any information given.

Prices

The prices indicated on mathewsandpeters.com are shown in US Dollars and do not include delivery. The delivery costs are clearly shown and invoiced at the end of the order in addition to the price of the products. We reserve the right to modify our prices at any moment but this will be indicated to you on the order at the time the order is placed. If an obviously incorrect price appears on our website and is not corrected on your total at the time of order completion, for whatever reason (human error, technical error etc.), your order will be cancelled and the payment refunded to you, even if it has been initially validated.

Availability

Product availability and preparation times vary by item. If we learn that an item is unavailable or cannot be shipped within the stated timeframe, we will notify you promptly.

For a delayed shipment, we will provide a revised shipping date when available, or explain if we cannot provide a reliable date. We will explain your options to accept the delay or cancel the unshipped item for a prompt refund, and obtain any consent required by applicable law. If we cannot fulfill the item, or cancellation is otherwise required, we will promptly issue the required refund to the original payment method.

If your order contains both available and delayed items, we will confirm the shipping arrangements with you. Any shipping-fee refunds promised for the unshipped portion of your order will be honored.

We may offer a replacement of equal price and quality for an unavailable item, but we will not substitute a product without your approval. If you accept a replacement and subsequently return it in accordance with our Return Policy, Mathews & Peters will cover the return postage.

Cancellation and refund rights for unshipped merchandise are separate from the return conditions for delivered items. Nothing in this section limits your rights under applicable law.

Secure payment

Mathews & Peters currently offers Visa, MasterCard, American Express, Discover, Diner’s Club, & PayPal to pay for your order. These payment options use advanced SSL encryption to keep your transaction secure and do not cost you anything to use (Mathews & Peters is charged as the seller, you are not charged as the buyer) so you will not pay any extra for your order. You do not need to hold an account with these Merchants to use these methods of payments.

Delivery

Orders are shipped to the delivery address provided at checkout. Please review your address carefully and contact us promptly if a correction is needed. Address changes may not be possible once fulfillment has begun.

Processing, production, and handling times vary by item and are separate from carrier transit. Expedited shipping does not shorten item preparation time. If an item cannot be shipped within the stated timeframe, we will follow the notification, cancellation, and refund process described under Availability.

For delivery questions, a damaged package, or an order that appears lost or is marked delivered but has not been received, please email mathewsandpeters@gmail.com with your order number and details of the issue.

Mathews & Peters will coordinate the review with the fulfillment partner and carrier and keep you informed. We may request photographs or other information needed to investigate. Please retain the packaging and any damaged items while we provide further instructions.

We will explain the resolution available based on the circumstances, including any applicable replacement or refund. A carrier investigation does not suspend or limit any refund or other remedy required by applicable law.

Right of Return

Eligible items may be returned within 15 days from the date of receipt, in accordance with our Return Policy. Items must be unused, in their original packaging, and in a condition suitable for resale. Please review the Return Policy for eligibility requirements and exclusions, including personalized and custom pieces.

To start a return, please email mathewsandpeters@gmail.com with your order number, the item you wish to return, and the reason for your request. Please contact us before mailing your package so we can confirm eligibility, the return address, and shipping instructions.

Return shipping is customer-paid unless we confirm otherwise in writing or applicable law requires otherwise. Please follow the packaging, tracking, and insurance guidance in our Return Policy.

Nothing in this section limits any rights you may have under applicable law.

Refunds

Refunds for eligible returns are issued to the original payment method. Please see the “Receiving a Refund” section of our Return Policy for processing information.

This information enables us to generate statistics based on data from visitors to our site and suggest products that might interest you according to the items that you selected when you previously visited the site. Cookies do not contain any confidential information about you.

All fraudulent use of this content that violates the rights held by a third party constitutes an offence of forgery, which is severely punished under the Intellectual Property Code.
